Agreement between Participant and San Diego Mommy & Me  

Welcome to San Diego Mommy & Me (SDMM). The www.sdmommyandme.com website (the “Site”), Renata Cameron (RC), and SDMM group services are available to Participants conditioned on their acceptance without modification of the terms, conditions, and notices contained herein (the “Terms and Policies”). An individual’s use of Site or purchase of the SDMM group series constitutes their agreement to all such Terms and Policies.

Please read these terms carefully, and keep a copy of them for your reference.

www.sdmommyande.com is an E-Commerce Site. This website is used to process registrations for mommy and me discussion groups and host SDMM related content. 

 

Cancellation/Refund Policy

You may cancel or postpone your group registration prior to your group series commencement. In order to be eligible for a refund, I require at least 5 days’ notice prior to the start date of group. If you provide less than 5 days’ notice, you will still receive a refund IF your spot is filled by a waitlisted participant. Please note, 3rd party transaction fees may not be refundable. Once your class series has begun, you are no longer eligible for a refund.  However, Renata Cameron (RC) will work with you to resolve any issues and identify a mutual solution. Group postponement is dependent on available space.  

Attendance Policy

San Diego Mommy and Me (SDMM) groups are considered “closed groups.” Meaning, you end with who you start with. This formate greatly benefits the group experience. For that reason, SDMM groups are sold as a packaged service. Participants cannot purchase a single class, nor is reimbursement offered for classes they are unable to attend.

That said, for one reason or another, it is super common to have to miss a class or two. Luckily, this does not affect the overall impact or experience.

Class Cancelation Policy  

In the rare event that a class is canceled due to illness or a personal emergency,  your group series will be extended by a week to make up for the missed day. Should two classes need to be rescheduled, the second makeup class will not fall on the same date or time as the official group series or will be offered virtually. If unforeseen circumstances prevent the extension or rescheduling of a canceled class(es), participants will be provided with access to the canceled class(es)’ curriculum and the above cancellation/refund policy will be enforced.

No Sick Policy

To best protect the health and wellness of participants and their little ones, SDMM requires all participants to follow a “no sick” policy. COVID-19 Refund Policy

If, for any reason outside of SDMM’s control, SDMM must cease holding in-person classes, all current, in-session classes will move to an online format when applicable. In this case, the cancellation/refund policy will be enforced.

 

Private Information

SDMM and Site collect personal information for the exclusive use of processing participants’ registration and providing SDMM services. Participant’s personal information will never be sold or provided to outside solicitors or groups. RC is prohibited from collecting any personal health information (PIH), thus all PHI provided to RC is done so on a voluntary basis. To promote collaborative and meaningful conversations, participants agree to keep personal or identifying information shared in SDMM confidential.

 

Liability/ Hold Harmless Policy

In return for being permitted to participate in SDMM group series, including any associated use or of the premises/facilities and contact/access to RC, curriculum, Site, and group participants, you agree to release, waive, discharge, and promise not to hold liability RC or SDMM from any and all claims, resulting in personal injury (including death), accidents or illnesses, and property loss, in
connection with your or your little’s participation in SDMM and any use of the premises and facilities.

Personal Responsibility 

At all times during SDMM, participants are responsible for their + their little’s safety. Likewise, information shared on Site, or in SDMM groups (by facilitator or participants) is for informational purposes only and is NOT a substitute for individualized medical or psychological advice.

Participants agree to seek individualized support if they have any questions regarding the medical or psychological well-being of themselves or their little one.

Participants agree to help SDMM maintain its status as an up-to-date, accurate, and safe information source by notifying RC if you come across any information that you perceive to be: inaccurate, misleading, sham-inducing, or harmful in any way. 

Assumption of Risks

Participation in SDMM carries with it certain inherent risks that cannot be eliminated regardless of the care taken to protect and promote the safety and wellbeing of group participants. The specific risks vary from one individual to another, but participation risks range from 1) exposure to viruses and bacteria 2) minor physical injuries 3) misinformation or miscommunication to 4) dissatisfaction with service or experience.

Indemnification

The Site, SDMM, and RC showcases educational content collected, organized, and/or created by RC. By purchasing an SDMM group series participants agree to indemnify and hold RC harmless from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney’s fees, arising out of participants’ access and/or involvement in SDMM, and to reimburse it for any such expenses incurred.

Severability

Participants further agree that their Waiver of Liability, Assumption of Risk, and Indemnity Agreement is intended to be as broad and inclusive as permitted by law, and that if any portion is held invalid the remaining portions will continue to have full legal force and effect. 

 

SDMM Curriculum Terms of Usage

The Site, SDMM groups, and electronic communication showcase educational content collected, organized, and/or created by RC. To the best of RC’s knowledge, all information is up-to-date, empirically supported, and widely accepted theories from the fields of Psychology and Child Development. SDMM participants are granted a non-exclusive, non-transferable, revocable license to access and use this educational curriculum strictly in accordance with these terms of use. As a condition of participant’s access, participants warrant to SDMM that they will not use the curriculum for any purpose that is unlawful or prohibited by these Terms. All content included as part of the curriculum, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Site, is the property of SDMM and protected by copyright and other laws that protect intellectual property and proprietary rights. As a condition to participants’ access to said content, participants agree to use protected content solely for their personal use and will make no other use of the content without the express written permission of RC and the copyright owner.

Group Participation Policy

San Diego Mommy and Me groups are a non-denominational group that is open to ALL “moms” regardless of their religion/race/culture/sexual orientation/gender identity/etc. Likewise, whether you breast or bottle feed, work or stay home, choose organic or Kraft Mac n’ Cheese, and so on… you belong here.

Personal Responsibility

To ensure a positive, productive, and empowering experience, all participants commit to:

  • A safe environment in which all feel respected + valued
  • Open, inclusive, and honest engagement (per individual comfort levels)
  • Information, advice, and opinions free from judgment or criticism.

Sensitive Issue Within Group

RC will privately speak with participants who engage in a manner that hinders group dynamics or an individual’s personal experience with the intent of identifying a mutually agreed-upon solution.

If concerns arise about a group member’s emotional/physical well-being or safety, RC will initiate a private discussion via email.

Participants agree to direct all urgent or immediate concerns to San Diego’s emergency providers: 911, San Diego Acess and Crisis Line, nearby emergency room/urgent care facility. 

Limits to Confidentiality

As a mandated reporter, California Law requires RC to report actual or suspected child/spousal abuse and/or neglect to the appropriate authorities. Additionally, RC is mandated to report any life-threatening concerns about participants potentially harming themselves or another person.

RC will inform the associated participant if a report needs to be made unless unique circumstances prevent RC from doing so. 

Electronic Communications

Visiting www.sdmommyandme.com or sending emails to RC constitutes electronic communications. By registering or initiating electronic communication, you consent to receive electronic communications and you agree that all agreements, notices, disclosures, and other communications that we provide to you electronically, via email, and on the Site, satisfy any legal requirement that such communications be in writing.

Photo Release

By attending SDMM, participants agree to the legal use of their and their little one’s images for personal and/or marketing use. That said, RC and SDMM participants will be mindful of others’ participants’ personal preferences when taking and sharing pictures online. Upon request, RC and SDMM participants agree to protect participants’ and/or their baby’s identity to the best of their ability.

 

Changes to Terms and Policies

RC reserves the right, in its sole discretion, to change the Terms and Policies under which SDMM and Site is offered. The most current version of the Terms and Policies will supersede all previous versions. SDMM encourages you to periodically review the Terms and Policies to stay informed of any updates.
